1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Baltic Mobile OÜ regarding your access to and use of aincome.io and all related services, features, content, software, and applications (collectively, the "Services").

By accessing or using the Services, creating an account, purchasing a subscription, or otherwise interacting with the Services, you agree to be bound by these Terms, our Privacy Notice, Cookie Policy, and Subscription, Renewal and Refund Policy.

If you do not agree to these Terms, you must discontinue use of the Services immediately.

Premium subscription features;

We reserve the right to modify, update, suspend, or discontinue any feature of the Services at any time.

4. Eligibility

The Services are intended solely for individuals who are at least eighteen (18) years old.

By using the Services, you represent and warrant that:

We reserve the right to investigate suspected violations and take appropriate action, including account suspension or termination.

7. AI Service Disclaimer

The Services may utilize artificial intelligence technologies to generate content, recommendations, responses, conversations, and other outputs.

You acknowledge and agree that:

AI-generated content is produced automatically and may contain inaccuracies, omissions, or errors;
AI-generated responses are provided for informational and entertainment purposes only;
AI-generated content should not be considered professional, legal, medical, financial, psychological, therapeutic, or other professional advice;
You are solely responsible for evaluating any information provided through the Services before relying on it.

We do not guarantee the accuracy, completeness, reliability, or suitability of AI-generated content.

You should seek qualified professional advice before making decisions based on information obtained through the Services.

8. No Medical, Psychological, or Professional Advice

The Services are intended solely for informational, educational, self-development, and entertainment purposes.

The Services are not healthcare services and do not provide:

Medical advice;
Psychological counseling;
Mental health treatment;
Therapy services;
Psychiatric services;
Legal advice;
Financial advice.

Use of the Services does not create any doctor-patient, therapist-patient, attorney-client, fiduciary, or similar professional relationship.

If you are experiencing a medical emergency, mental health crisis, or other urgent situation, contact appropriate emergency or professional services immediately.

9. User Content

You retain ownership of your User Content.

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, process, store, reproduce, modify, and display such content solely for the purpose of operating, maintaining, improving, and providing the Services.

You represent and warrant that:

You own or have the necessary rights to submit the User Content;
Your User Content does not violate any law or third-party rights;
Your User Content does not contain unlawful, defamatory, infringing, or harmful material.

We reserve the right, but not the obligation, to remove or restrict access to User Content that violates these Terms.

10. Subscription and Billing

Certain features of the Services are available only through a paid subscription.

By purchasing a subscription, you authorize us and our payment service providers to charge the applicable subscription fees using your selected payment method.

Subscription plans, billing periods, pricing, and available features will be displayed during checkout.

Subscriptions automatically renew unless cancelled before the renewal date in accordance with our Subscription, Renewal and Refund Policy.

You are responsible for maintaining valid payment information and ensuring that recurring payments can be successfully processed.

We reserve the right to suspend or terminate access to paid features if payment cannot be successfully collected.

11. Payment Processing

Payments are processed by independent third-party payment service providers.

We do not directly process or store complete payment card information.

Payment processing is subject to the applicable terms and privacy policies of the payment provider used to complete your transaction.

We are not responsible for errors, interruptions, delays, or failures caused by third-party payment providers.

12. Chargebacks and Payment Disputes

If you believe that a charge was made in error, you agree to contact our support team before initiating a chargeback or payment dispute with your financial institution.

We reserve the right to provide relevant account records, transaction data, subscription information, usage records, acceptance logs, and communications as evidence in connection with chargeback investigations.

Where permitted by applicable law, accounts associated with fraudulent, abusive, or excessive chargeback activity may be suspended or permanently terminated.

13. Intellectual Property

The Services and all related content, including but not limited to software, designs, graphics, text, interfaces, trademarks, logos, audio, video, AI models, databases, and other materials, are owned by Baltic Mobile OÜ or its licensors and are protected by applicable intellectual property laws.

Except as expressly permitted under these Terms, you may not:

Copy, reproduce, distribute, publish, or publicly display any part of the Services;
Modify, adapt, translate, or create derivative works;
Reverse engineer, decompile, or attempt to extract source code;
Use our trademarks, branding, or intellectual property without prior written permission.

All rights not expressly granted under these Terms are reserved.

14. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR AVAILABILITY.

WE DO NOT WARRANT THAT:

THE SERVICES WILL OPERATE WITHOUT INTERRUPTION;
THE SERVICES WILL BE ERROR-FREE;
DEFECTS WILL BE CORRECTED;
THE SERVICES WILL ALWAYS BE SECURE;
THE SERVICES WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS;
AI-GENERATED OUTPUTS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BALTIC MOBILE OÜ, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

THIS INCLUDES, WITHOUT LIMITATION:

LOSS OF PROFITS;
LOSS OF REVENUE;
LOSS OF BUSINESS OPPORTUNITIES;
LOSS OF DATA;
LOSS OF GOODWILL;
BUSINESS INTERRUPTION.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY. IN SUCH CASES, THE ABOVE LIMITATIONS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

16. Indemnification

You agree to defend, indemnify, and hold harmless Baltic Mobile OÜ, its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from:

Your use of the Services;
Your violation of these Terms;
Your violation of any law or regulation;
Your infringement of any third-party rights;
Any content submitted by you through the Services.

17. Termination

Termination by You

You may stop using the Services at any time.

You may terminate your account by contacting us at support@aincome.io or through any account management functionality made available within the Services.

Termination of your account does not automatically entitle you to a refund. Refund eligibility is governed by our Subscription, Renewal and Refund Policy.

Termination by Us

We reserve the right, at our sole discretion, to suspend, restrict, or terminate your access to the Services immediately and without prior notice if:

You violate these Terms;
You violate applicable laws or regulations;
We reasonably suspect fraudulent, abusive, or unauthorized activity;
Your actions expose us, other users, payment providers, or third parties to legal, financial, reputational, or security risks;
We are required to do so by law, regulatory authorities, or payment partners.

Effect of Termination

Upon termination:

Your right to access and use the Services will immediately cease;
Any outstanding payment obligations will remain in effect;
Provisions that by their nature should survive termination shall remain enforceable, including intellectual property rights, disclaimers, limitations of liability, indemnification obligations, and dispute resolution provisions.

18. Governing Law

These Terms and any disputes arising out of or relating to the Services shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to conflict of law principles.

If mandatory consumer protection laws of your country of residence provide additional protections, such protections shall remain unaffected.

19. Dispute Resolution

We encourage users to contact us first to resolve any concerns informally.

The parties agree to make reasonable efforts to resolve disputes through good-faith negotiations before initiating formal legal proceedings.

If a dispute cannot be resolved amicably, it shall be submitted to the competent courts of the Republic of Estonia, unless otherwise required by mandatory consumer protection laws applicable to the user.

Nothing in these Terms limits either party's right to seek injunctive relief, equitable remedies, or protection of intellectual property rights before a court of competent jurisdiction.

20. Changes to the Services and Terms

We reserve the right to modify, update, suspend, or discontinue any part of the Services at any time.

We may also amend these Terms from time to time.

When material changes are made, we may provide notice through the Services, by email, or through other reasonable means.

The updated version of the Terms becomes effective upon publication unless otherwise specified.

Your continued use of the Services after the effective date of revised Terms constitutes acceptance of the updated Terms.

21. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Notice, Cookie Policy, and Subscription, Renewal and Refund Policy, constitute the entire agreement between you and Baltic Mobile OÜ regarding the Services.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver

Failure by Baltic Mobile OÜ to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment

We may assign, transfer, or delegate our rights and obligations under these Terms without restriction.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, governmental actions, labor disputes, internet outages, cyberattacks, or failures of third-party providers.
